Earlier this week the government has taken the first steps to overhaul the controversial Deprivation of Liberty Safeguards (DoLs) with a revised scheme called the Liberty Protection Safeguards. Central to this is still the basic rights that individuals have including that of their liberty.
The revised system intends to be simpler and cover all care settings. It will also have a two tier system reducing the number of assessments needed in certain scenarios and allowing a broader range of professionals to undertake them. There should be a greater focus on individuals whereby a concern has been raised rather than a “blanket” approach necessitating a Court of Protection process being applicable in all circumstances. This had resulted in an increase from 13,000 applications in 2013-2014 to over 210,000 in 2016-2017. It is estimated that there could also be a cost saving of up to £200 million pounds per year of public monies.
